1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Thornmark", "we", "us", "our" — Thornmark, an educational organisation registered and operating in Malaysia, with its principal place of business at 53 Jalan Tun Sambanthan, 50470 Kuala Lumpur.
• "Website" — the Thornmark website accessible at thornmarks.site and any associated subdomains or pages.
• "Programme" or "Service" — any educational workshop, course, cohort, or facilitated session offered by Thornmark, whether delivered in person or through a combination of in-person and printed materials.
• "Participant" or "you" or "your" — any individual who accesses the Website, submits an enquiry, or enrols in a Programme.
• "Content" — all text, printed materials, reference cards, workbooks, course guides, illustrations, and other materials produced or curated by Thornmark as part of a Programme.
• "Agreement" — these Terms and Conditions, together with any programme-specific enrolment confirmation provided to you.

2. Acceptance of Terms

By accessing the Website or registering interest in a Programme, you confirm that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement.
• You accept these Terms and Conditions in full, without reservation.

If you do not accept any part of these terms, please do not use the Website or register for a Programme. We recommend that you print or save a copy of these terms for your records.

3. Our Services

Thornmark provides structured public-education programmes focused on consumer financial awareness — specifically, helping individuals and households recognise and respond to common patterns of financial misuse that have been reported publicly in Malaysia. Our current programme offering includes:

• Common Patterns Workshop

  A one-day workshop reviewing publicly documented categories of consumer-targeted financial misuse. The session covers what households can do to slow down, ask questions, and seek help from the appropriate authorities. A printed reference card is included. This session is educational only and does not constitute individual case advice.

• Household Safety Conversations Programme

  A four-session evening programme on the conversations households can have to keep one another informed about common consumer-financial risks, including phone-call and message patterns, and public guidance from authorities such as Bank Negara and the police. Includes a printed conversation deck and a workbook. Educational only.

• The Family Awareness Cohort

  A 10-week cohort programme combining awareness of common financial-misuse patterns with household-conversation habits, designed for adults aged 40 and above. Includes a printed reader, weekly facilitated sessions, a peer discussion forum, and a printed closing reference guide pointing to official channels. Educational only.

All Thornmark programmes are general education offerings. They do not constitute financial advice, legal advice, counselling, or any other regulated professional service.

Programme availability is subject to sufficient enrolment, facilitator availability, and scheduling. We reserve the right to adjust session dates, locations, or programme content with reasonable advance notice. Geographic availability is currently limited to participants who can attend sessions in Kuala Lumpur in person.

4. Programme Enrolment

Enrolment in a Programme is completed when:

• You submit a completed registration enquiry through our website or contact form.
• We confirm your place in writing (by email).
• Payment has been received in full prior to the programme commencement date.

A confirmed enrolment does not constitute a licence to reproduce, distribute, or commercialise any programme Content.

For the Family Awareness Cohort, participation is open to adults aged 40 and above. We reserve the right to decline an enrolment request where eligibility criteria are not met.

You are responsible for providing accurate and complete registration information. If information provided at enrolment is materially inaccurate, we may cancel the enrolment without refund.

5. Payment Terms

Programme fees are as follows, inclusive of all stated materials:

• Common Patterns Workshop: RM 470 per participant
• Household Safety Conversations Programme: RM 1,150 per household group (up to the stated group size)
• The Family Awareness Cohort: RM 2,490 per participant

All fees are quoted in Malaysian Ringgit (MYR) and are inclusive of printed materials unless otherwise stated in your enrolment confirmation. Fees do not include transport, accommodation, or any other personal expenses.

Payment is due in full upon receipt of our invoice and no later than seven (7) calendar days before the programme start date. We accept payment by bank transfer. Details are provided in the enrolment confirmation. A place is held on a provisional basis until payment is received; if payment is not received by the due date, the provisional place may be released.

We do not store payment card information. Any payment processing is handled through the payment method agreed at enrolment.

6. Cancellation and Refunds

Cancellations by participants are subject to the following schedule, calculated from the programme start date:

• 14 or more calendar days before start: Full refund of the programme fee.
• 7 to 13 calendar days before start: 50% refund of the programme fee.
• Fewer than 7 calendar days before start: No refund. A transfer of your place to a future intake of the same programme may be offered at our discretion.

All cancellation requests must be submitted in writing to [email protected]. Refunds, where applicable, will be processed within 14 business days of the cancellation confirmation.

If Thornmark cancels or postpones a programme due to insufficient enrolment, facilitator unavailability, or circumstances outside our reasonable control, enrolled participants will be offered either a full refund or a transfer to the next available intake.

Printed materials distributed prior to a programme start are not returnable.

7. Your Responsibilities

By accessing the Website or participating in a Programme, you agree to:

• Provide accurate, current, and complete information when registering or submitting an enquiry.
• Attend sessions with reasonable punctuality and respect for other participants and facilitators.
• Use programme Content for personal, non-commercial educational purposes only.
• Not record, photograph, reproduce, or distribute session Content or printed materials without prior written permission from Thornmark.
• Not use the Website for any unlawful, deceptive, or disruptive purpose.
• Not attempt to gain unauthorised access to any part of the Website or its underlying systems.
• Comply with all applicable Malaysian laws and regulations in connection with your use of the Website and participation in a Programme.

We reserve the right to remove any participant from a Programme — without refund — if their conduct is found to be disruptive, disrespectful, or in breach of these terms.

8. Intellectual Property

All Content on the Website and within Thornmark programmes — including text, printed materials, reference guides, workbooks, session structures, illustrations, and any other materials — is the intellectual property of Thornmark or is used with appropriate permission.

Upon enrolment, Thornmark grants you a limited, non-exclusive, non-transferable, personal licence to use programme Content for your own educational purposes. This licence does not permit:

• Reproduction or redistribution of printed or digital Content to third parties.
• Use of Content for commercial training, coaching, or consulting purposes.
• Modification, adaptation, or creation of derivative works from the Content.
• Any use of the Thornmark name, logo, or materials in a way that implies endorsement.

Any feedback, suggestions, or ideas submitted to Thornmark (e.g. through a contact form) may be used by Thornmark without obligation or compensation.

9. Disclaimers

Thornmark's programmes and Website are provided for general educational and informational purposes only. Please note the following:

• Programme Content draws on publicly available information and reported patterns. It is not tailored to your personal financial situation, household circumstances, or any specific case.
• Thornmark is not a licensed financial adviser, legal practitioner, or counselling provider. Nothing in our programmes or on this Website constitutes financial advice, legal advice, or any other regulated professional service.
• Participants are encouraged to seek guidance from appropriate licensed professionals and official authorities (such as Bank Negara Malaysia or the Royal Malaysia Police) for matters relating to their specific circumstances.
• The Website is provided on an "as available" basis. We do not warrant that the Website will be free of errors or uninterrupted at all times.
• Links to third-party websites or resources on this Website are provided for convenience only. Thornmark does not endorse or assume responsibility for third-party content.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law:

• Thornmark shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Website or participation in a Programme.
• Thornmark's total liability to you for any claim arising out of or in connection with these terms shall not exceed the programme fee paid by you for the relevant Programme.
• We are not liable for circumstances beyond our reasonable control, including but not limited to natural events, disruptions to public utilities, or public health directives that affect programme delivery.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other matter where limitation of liability would not be permissible under Malaysian law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Thornmark, its facilitators, staff, and associates from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Website in breach of these terms; (b) your participation in a Programme in breach of the conduct expectations described in Section 7; or (c) any misrepresentation of information provided during registration.

12. Termination

Either party may bring this Agreement to an end:

• By you: By cancelling your enrolment in writing, subject to the refund schedule in Section 6, or by ceasing to use the Website.
• By Thornmark: By providing written notice if you are in material breach of these terms and such breach has not been remedied within 7 days of notice, or immediately where the breach involves conduct that disrupts other participants.

Sections 7 (Your Responsibilities), 8 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Dispute Resolution) survive termination of this Agreement.

13. Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia.

In the event of any dispute arising out of or in connection with these terms or a Programme, we ask that you first contact us at [email protected] to give us the opportunity to resolve the matter informally. We will endeavour to respond to any complaint within 10 business days.

If informal resolution is not achieved within 30 days of your written notice of the dispute, either party may refer the matter to the courts of Malaysia, and both parties submit to the exclusive jurisdiction of the Malaysian courts.

Participants who are consumers may also refer complaints to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) where the dispute falls within its jurisdiction.

14. General Provisions

• Entire Agreement: These terms, together with any enrolment confirmation, constitute the entire agreement between you and Thornmark with respect to the subject matter hereof and supersede all prior communications.
• Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Failure by Thornmark to enforce any provision of these terms shall not constitute a waiver of that provision or of any other provision.
• Assignment: You may not assign your rights or obligations under these terms without our prior written consent. Thornmark may assign these terms in connection with a transfer of its business operations.
• Notices: Written notices to Thornmark should be sent by email to [email protected] or by post to the address in Section 16. We may provide notices to you at the email address provided at registration.

15. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our programmes, applicable law, or operational practice. When we do so, we will update the "Last Updated" date at the top of this page. Where changes are material, we will take reasonable steps to bring them to your attention. Continued use of the Website or participation in a Programme after an update constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
